I think that the declaration by the Govt that Moi Day is not a holiday is a political decision, rather than a legal one. Since 2002 the Govt has always wondered what to do with Moi Day but not wishing to be seen bashing Moi and his ilk has opted to remain vague as to the status of the day. The new Constitution has offered a perfect excuse, though illegal.

As Mpenzi has put it legally Monday is a public holiday. Whether it will be observed is a totally different question.

Indeed Mon the 11th Oct is a public holiday but it is an american holiday called the Colombus day no more moi day

But if my mind is clear, Monday will be 11th and hence not a Holiday!!! any legal interpretation?

@Tebes, when a holiday falls on a Sunday, Monday is then considered a holiday
