Tenant went MIA - what to do

I had a tenant in a studio type of house (self contained bed sitter) rented at 10k who started dodging rent around March - April with all sorts of excuses....and by May stopped residing there and has since gone missing.

Its now 7 months and I need to let out the place - what recourse do I have? Can I throw his stuff out? BTW I'm not interested in working with auctioneers or going the court way.

If you want to be legit then you have no choice but to go the bolded way. Get an auctioneer to go to court for a break in order then they will go and get the police, gain entry and legally auction off any of the tenant's stuff out. Will take about 3 days or so depending on how good the auctioneer is. If you go any other way then the tenant can resurface and sue you for among other things the USD 200k he had left in the house.

@elder, Thanks. Then I suppose I have to work with an auctioneer...esp if it will take three days....

Just another fact - the guy is "mteja" on all three phone numbers...for the last 5 months or so.

It is a fairly straight forward matter and does not take years like the proverbial Kenyan court cases. The auctioneer will apply to court and ask the court for a break in order with evidence of the tenancy. The order shall be issued and they shall be good to go. Talk to any auctioneer and they can give you more details.

7 Months times 10,000 = 70,000

Maybe this guys goods arent even worth the 70,000. That's why he is bolted to start elsewhere afresh.

I would go with @elder's advice

@Djinn - There are new rules that cover auctioneers. They came into effect this year - I believe. You should familiarize yourself with them to see how they affect your situation.
Never count on making a good sale. Have the purchase price be so attractive that even a mediocre sale gives good returns.

kyc - know your customer. Take the first month of tenancy to know his wife, girlfriend, mother, village, place of work, drinking joint, village. You will come across as nosy, but it always helps.

I for instance insist that my tenants respond to an email have have sent to their corporate email address before they move in.
