What's your take on my dilemma?

My car has been stuck in a garage for one month now after it was involved in an accident. According to the police abstract,it was the other driver who was on the wrong and therefore was to meet the cost of damage and repair on my car. His insurance was ok and the garage where I took my car agreed to repair after going through all the formalities with my insurance company.





The garage says my car is 70 percent repaired,but want the insurance to pay more money (30k extra) since the first assesment was undervalued! They have refused to release my car until more money is added. It's me who is now losing as the bickering continues between the garage and my insurance company. The garage keeps calling me but I told them to deal with insurance,I will only pay the excess after the car is complete. What should I do,can I sue the garage? insuarance? Or even the person who crashed into my car for all the loses am experiencing?

Before you sue anyone and incur legal fees,why dont you seek assistance from AKI first? I think they can intervene and the insurance will not want to be reported to the authorities. its the insurance to sort out the issue with the garage.

Some deals are like glass. Sometimes it's better to leave them broken than try to hurt yourself putting it back together.

going legal way might consume more than the 30K in dispute...

but lets leave it to the lawyers in the forum...

@jaribu: Pole for your misfortune. Been involved in a similar dilemma a few months ago. The garage had also claimed that their first quote was undervalued and insurance refused claiming that the initial quote was even too high. After two weeks of haggling, I realised that the garage and insurance company (of the guy who'd hit me) were in cahoots to make some money off me!

My advise! Talk to the insurance company of the guy who hit. Talk to the claims manager. Then review the initial quote and compare with another garage. AKI may be also useful as Wendz proposes.

Experienced almost a similar scenario last year,my car had an accident apparently the garage underestimated the cost so there was a tussle between the insurance and the garage,it took four months for the repairs to be completed.

Don't give up pursue the issue with AKI
