New constitution Implementation

The process so far:

A bill on the judiciary has already been passed



More bills are being drafted for passage in the shortest time possible.(MPs will have their busiest time ever)

The President,PM and Ministers continue holding on to political party positions in contravention of the new law

There's confusion as to what will be the fate of the Provincial Administration with the govt officials giving conflicting signals(Is it going to be disbanded or not,Is it going to fall under county or national government?What will be its powers?)

Politicians are confused on which seats to vie for.There's a major demand for the senate seat(which IMHO,is subordinate in power to the National Assembly seat in terms of powers and duties allocated).We also have county governor's seat.

It's still not clear on the fate of local authorities.

It's still not clear how many slots we'll vote for in Aug 2012.Njoki Ndung'u gave us 7 namely:councillor, rep to county govt,governor,MP,senator,woman rep from county in the national assembly and President

The fate of local authorities is unclear.A look into the fourth schedule shows a clear overlap between county duties and those of councils presently

The implementation continues...

Most are minor teething problems.Happy that options already on the table,whats remaining is to make a decision. The grey area that worries me is the fate of the Provincial administration and local authority.The document/committee should have been decisive about this.
Hoping that the implementation/parliament will rise to the occassion to design a structure that is in the spirit of the new constitution.
The converse will give us a skeleton structure-responsibilities but NO POWERS.

The silence was intentional. What I'm wondering is, why the confusion in government? Kwani they didn't know when they were campaigning for the draft that these guys do not feature in there?

The hullabaloo about the provincial administration is just for nothing, even in the previous constitution The PC and the DC were not on the constitution The chiefs on the other hand were protected by an act of parliament.

The PC ,DC,DOs and Chiefs represent the president in their respective administrative units.

IMHO these administrators will be restructured according to the new administrative units (counties).They are under the office of the president and as long as that office exist these administrator will continues carrying their functions as before only that The PC and some DC will be assimilated into the civil service.

The hullabaloo about the Provincial Administration is about who controls the change process. Its obvious that the central govt will need to have a presence throughout the country whether thro system called provincial admin or otherwise - how that system operate will largely depend on who is in control of the central govt particularly in the next 5 years or so.

The confusion continues...I agree with the Sunday Nation that a lot of civic education is needed to manage expectations of Kenyans.Jostling for positions has started with county professional bodies angling for key county gvt positions.Politicians are stil mistakenly overhyping senatorship, a seat whose power is lower than that of National assembly.Counties are bearing the greatest burden of misplaced expectations.They are, just a bit better in terms of power than current councils.And talking of councils, why should we stil have them when their duties conflict with those of county govt?
