Toxicity, I was in the same boat a while ago, and managed to get my funds back.
The funds would normally be in "reserved" state, awaiting to be claimed by the payee. (You should see this in your statements).
The bank has to organize with the Card Centre guys for the "reserved" funds to be unfrozen. For this, you will be required to sign an indemnity form. (It would greatly help if you present any documents related to the trasaction).
After the completion of background checks by card centre, you should get your funds back.
The sticky point would be if the payee indeed claimed the "reserved" funds, in which case you need to follow up with the payee.
Otherwise, there is a limit to the duration in which funds may stay in "reserved" state following a card transaction. After the lapse of this period (not sure if it's 90 days), the funds will automatically be made available to the payer.
