A case being determined in a record 1 year,he he he! If it involved the ordinary joe the plumber,it would have taken 14 years with files vanishing in thin air. But if lucky and getting some peanut compensition of about 350k,the lawyer would have 'eaten' your money and demanded more for his hard work. Kweli we live in a banana republic. One law for them and one for us!

I don't claim to know much about Kenyan 'credit cards' but I have to say that KCB got off very easy.

In fact, you have ever gone through such, you should sue KCB and any company that behaves like Nakumatt. Frog marching people around is not good customer service.

I have on very many occasions tried to use a credit card without knowing that I am over the limit or it has expired. Never in my life was I humiliated and made to look like a common thief. If you think that is ok,then you need help and should never start a business anywhere other than Kenya.

Let this judge be the one who opens the eyes of the public on how you should be treated when you are spending money. KCB is making billions of shillings in profits, can't they come up with a system where they can automatically figure out if someone has enough funds? What is this nonsense of calling a clerk somewhere to figure out if one has enough funds.

I think we are in 2009 and if these banks cannot give good service then I can assure you that I will be the next Judge and I am patient enough to wait for 3 yrs to make 1 million without any capital risked on my part.

@ alma, you are over reacting on this particular case, credit card business is the same all over the world. I hold more than fifteen credit cards including a K.C.B Gold card which is accepted anywhere in the world.

Millions of people all over the world have had their cards rejected for some reason or the other but they never take legal action. Like i said before he could have simply called the customer service and his problems would have been solved.

You can not simply exceed your agreed limit and think because you are a judge the world owes you a favour. He simply did not have sufficient funds in his account and that is entirely his responsibly to ensure that there enough funds for him to spend.

If he was manhandled by the Nakumatt staff badly then he should have sued them not K.C.B. however,i doubt that a loud month like this particular judge could have been manhandled without shouting to the whole world that he is judge of the high of Kenya.

Denied conjugal rights by whom? mistress or wife of more than 30 years what a pile of rubbish'

Lastly but not least i walked into Saks Fifth Avenue in April 2009 after a long trip in South America present my Platinum Amex for $1200.00 suit, the sales clerk called the police from the back of the store to come and verify if i was the owner of the card. That i would say was racist act but all a i got was an apology and a free Ike Bahr shirt.

@wote,

Are you a lawyer?A suit for 1,200$?

Just wondering does the bank have the right to terminate the credit card the judge has now that he has embarassed them as well?

Will any other bank accept an application from the judge for a credit card?

He is complaining about the KCB card. Please let him try BBK card and then he will appreciate the KCB card. Anyway I see him as an opportunist who is out to extort cash at the slightest provocation and with support from his learned pals.....

@wote...I am not complaining about having the card rejected.Like I have just said, that is normal and nothing to write home about......I think he won his money for being frog marched and humiliated in public just because his card was rejected......I know that may seem the same to most but it isn't and if I were you,I would have gotten more than a shirt from the owner of that shop..........You have got to be kidding me!....Please don't take Kenyanese out there. If a fool makes a mistake of pretending that you are a n....,please make sure you leave with more than a shirt next time...........If the jamaa was frogmarched, even nakumatt is lucky here. If he was a sissy, then KCB are fools since it would have cost them less than 2 million to settle it...........Basically KCB are the fools now and that is how they treat their clientelle. With arrogance,so they will pay again and again until they learn that the sissy, childish and con of a client is ALWAYS RIGHT.

@ alma, contracts for the credit cards are simillar all over the world and they specify what one is allowed to spent on such acredit cards. You simply cannot spend what you are not entitled to,however, should you decide otherwise then you will be the author of your own situation.

Like i said earlier,if the judge was manhandled'' which i highly doubt he should have enjoined nakumatt in his case against the credit card company.

On a light note, where exactly are you getting the manhandling aspect? it did not seem to be part of the evidence adduced before the court.'

....As said earlier,KCB n Nakumatt failed the customer service test. Such cases are sorted out better in the 'Manager's' office n not in the open. Juz wondering why the bank never resorted to out of court settlement having known the public duty of the client they were handling.....to avoid this public humilliation and unquantifiable damage

BTW...is this the same judge who has sued the Planning Minister over toilet covers?

I wonder about the heading-'KCB uncouthness' I wonder,if you have such strong negative sentiments against KCB,why, pray, have you been with them for ' a very long time and they have not stopped embarrassing you' ? Don't think they are holding a gun to your head-or money. But,that is besides the point. we Kenyans of the peculiar habits, routinely board matatus and are on cell phone networks where we are regulalry called names and still continue handing over our hard earned cash.

that said, this is a case where KCB were unlucky. That the suit was determined in under a year is proof that all did not go well. when the suit was filed and KCB put in their defence, the judge's lawyers made an application for their defence to be struck out. i.e,in 'mwananichi' parlance, the judge should make a summary decision that based on the documentation put forward by KCB,they were wasting time and had no real case. Apparently the judge agreed and struck out their defence. In fact,at the time the judge was granting the other judge 2.5 million,KCB lawyers had reportedly gone to the court of appeal and gotten an order stopping any further progress of the suit until the appeal was heard. Though the order was granted(again reportedly),it did not get to the High COurt judge in time and therefore the 'good' judge was granted Kes. 2.5 million.
So in allreality, the case was not heard and settled on its merits, rather on technicallity and the judge is not yet to smile his way to or from the bank.

Unfortunately, the intelligent think that everyone else is.Tragically, the obtuse believe they are intelligent.

What if 100,000 pple turn up to complain about Kcb...how much loss would be incurred on compensation, and so,what impact would that have on kcb's share Price?

Have you been Sucked up by KCB or YOUR Bank?

M'c Kende Siafu !

I have heard countless complaints about this KCB (kenya commercial bank). I used to think they were for nothing until they had me. It is the worst kenyan bank. Apparently I went for a loan from the bank (300,000). went through some useless procedures as far as registering my small business, paying many third parties. The loans officer assured me of success with the loan so I went with whatever they said I should do. All their loans are approved huko head office so these branches are mere live atms. I waited after application. Two days later went there only to be told 'head office walikataa'' despite all the assurance by the loans official. my a/c was nice. I was advised by friends to go to Equity bank. (a truly friendly bank) I opened an account there. They told me to give them my kcb account statement. I filled a loan form that was approved the following day. Equity branches approve loans upto 300,000. Si lazima head office. see the branch is in touch with the customer so I respect Equity bank for that. Ever since, my bank is equity. wait till kcb screws you over

The best ATMs and good number per location hence you will hardly get a nasuating queue in their ATMs...Coop ATM queues are worst followed by KCB.

They are a complete joke. I used to hear of people complaining and didnt understand until ii opened an account (The KCB guys had a drive at my workplace). What a disaster. Long ques at the ATM/ ATM card not working sometimes/ Funds not clearning on time - last straw was when they debited me for a loan i hadnt taken (Never had a loan facility with them). It took me a good three weeks to close my account - three weeks.

Moved to CBA after that and NIC - i have never found a better bank than CBA

Mambo ya kcb ni mazito sana. Around 2013 I applied for a small loan and even after 8wks, they were yet to approve despite all assurances. On the ninth week, I wrote a letter cancelling the application (they had the audacity to act shocked). Crossed over to Family, opened an a/c there, used kcb statements and had the cash in a week.

I sometimes back lost my wallet and with it lost all my ATM cards and my national ID. Imagine my shock getting my ID replaced before getting my KCB ATM card. Not to mention that I walked into Equity and 20 mins later walked out with my ATM card and PIN in hand!! Inefficiency beyond words!
